§ 42-32. Start of two-year maintenance agreement.

The subdivider shall maintain the streets in the subdivision in good condition for two years. The two-year period shall begin with the approval of the final plat by the city council and inspection of the streets by the city inspector or engineer. A letter stating that the two-year period has begun shall be drafted and sent to the subdivider and the project engineer and/or surveyor. A copy shall be filed with the city secretary/treasurer. Where subdivisions are developed in sections, final approval of the plat by sections may be given and the two-year maintenance responsibility of the developer for individual sections may be commenced before the completion of the entire subdivision.
